- The EUIPO rejected an application for BLACK IRISH for goods in Classes 30, 32 and 33 on the ground that it was descriptive
- The General Court agreed, finding that the public would perceive the mark as an indication of the colour and geographical origin of the goods
- The mark was descriptive of an intrinsic characteristic which is inherent to the nature of the goods
