IP Insights: General Court confirms that BLACK IRISH is descriptive for beverages

As part of the WTR series EUROPEAN UNION | Legal updates: case law analysis and intelligence, Andreea Bende, Partner, recently authored an overview titled “General Court confirms that BLACK IRISH is descriptive for beverages“.

The thesis:

  • The EUIPO rejected an application for BLACK IRISH for goods in Classes 30, 32 and 33 on the ground that it was descriptive
  • The General Court agreed, finding that the public would perceive the mark as an indication of the colour and geographical origin of the goods
  • The mark was descriptive of an intrinsic characteristic which is inherent to the nature of the goods
